1. Acceptance of Terms

These Terms of Service (the "Terms", "Agreement") constitute a legally binding contract between you ("User", "you", or "your") and **Siddhanta** (also referred to as **AstroMotion 3D**, "we", "us", or "our"), governing your access to and use of our web application, mobile applications, interactive 3D celestial orreries, Vedic astrology calculation tools, Astrologer CRM, and developer APIs (collectively, the "Platform" or "Services").

**BY CREATING AN ACCOUNT, PURCHASING A SUBSCRIPTION, OR ACCESSING ANY PART OF SIDDHANTA, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR [PRIVACY POLICY](./PRIVACY_POLICY.md). IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MUST IMMEDIATELY DISCONTINUE ALL USE OF THE PLATFORM.**

2. Statutory Astrological & Entertainment Disclaimer

A. Solely for Entertainment, Cultural, and Educational Purposes

**CRITICAL LEGAL NOTICE:**

All astrology calculations, Janam Kundali charts, planetary positions, D1–D60 divisional charts, Krishnamurti Paddhati (KP) significators, Vimshottari Dasha projections, Ashtakoot Milan matchmaking gunas, transit notifications, and AI-assisted astrological interpretations provided through Siddhanta are generated for **entertainment, cultural study, historical, and educational purposes only**.

B. Not Professional, Medical, Financial, or Legal Advice

Under no circumstances should any insight, score, planetary transit, dasha period, or astrological interpretation produced by the Platform be interpreted or used as:

**Medical or Psychiatric Advice:** Astrological indications do not diagnose, treat, prevent, or cure any physical illness, mental health condition, or ailment. Always consult licensed medical professionals for health matters.

**Financial or Investment Advice:** Planetary transits, Sade Sati, or wealth house (2nd/11th house) readings do not constitute certified financial, stock, tax, or investment advice. You bear sole responsibility for your investment decisions.

**Legal Advice:** Matchmaking compatibility, litigation timing, or dispute forecasts do not constitute legal counsel or legal representations.

**Life, Marital, or Career Guarantees:** Astrological calculations reflect mathematical planetary alignments and symbolic interpretations according to ancient Vedic traditions; they do **not** guarantee future events, outcomes, or personal compatibility.

C. Non-Reliance & User Assumption of Risk

You explicitly agree that you rely on any information provided by Siddhanta entirely at your own risk. Siddhanta, its founders, contributors, and affiliates disclaim any liability for decisions made, actions taken, or losses incurred based on astrological calculations, transit timings, or recommendations made through the Platform.

3. Eligibility & Minor Policy

**Age Requirement:** You must be at least **18 years of age** (or the age of majority in your jurisdiction) to establish an individual account, purchase subscriptions, or generate API keys.

**Charts for Minors:** Parents or lawful guardians may create and save natal charts for minor children under their guardianship. By inputting birth details of a minor, the parent/guardian explicitly confirms full legal authority and parental consent under Section 9 of India's Digital Personal Data Protection Act, 2023 (DPDP) and the US Children's Online Privacy Protection Act (COPPA).

4. User Accounts & Security

**Account Registration:** To access personalized features, saved horoscopes, and subscription tiers, you may register using an authorized email address or third-party authentication (Google OAuth 2.0). You agree to provide true, accurate, and current information.

**Account Security:** You are solely responsible for maintaining the confidentiality of your credentials and API keys. Any action originating from your account or API keys is deemed your responsibility. Notify us immediately at `security@astromotion.ai` if you suspect unauthorized access.

**Account Termination:** We reserve the right to suspend or terminate accounts that violate these Terms, engage in scraping, tamper with billing systems, or exhibit abusive behavior.

5. Subscriptions, Payments & Refund Policy

A. Subscription Tiers & Billing

Siddhanta offers **Free**, **Plus**, **Studio**, and **Enterprise** subscription tiers with monthly or annual billing cycles.

Pricing and included features (such as unlimited saved profiles, high-resolution PDF exports, white-label branding, and developer API credits) are clearly stated on our Pricing page.

Subscriptions renew automatically at the end of each billing period unless canceled before the renewal date.

B. Payment Gateways & Taxes

Payments are processed securely via third-party gateways: **Razorpay** (for domestic/international transactions) and **Stripe** (for international subscriptions).

Prices are displayed exclusive of applicable Goods and Services Tax (GST), Value Added Tax (VAT), or local sales taxes where legally required. Applicable taxes are calculated and added at checkout.

C. Digital Goods & Refund Policy

**Digital Deliverables:** Because digital astrology reports, calculations, and subscription benefits are unlocked immediately upon purchase, all subscription charges, single report purchases, and API credit packs are **strictly non-refundable once accessed or generated**, to the maximum extent permitted by law.

**Subscription Cancellation:** You may cancel your subscription at any time through the Billing Portal. Upon cancellation, your access remains active until the end of your current paid billing period; no partial or prorated refunds are issued for unused time.

**Disputed Charges & Technical Errors:** If you were charged in error due to a verified technical defect, duplicate transaction, or gateway failure, submit a refund claim to `billing@astromotion.ai` within seven (7) business days of the transaction date with transaction IDs.

6. Astrologer Studio & Professional CRM Intermediary Terms

Siddhanta provides an **Astrologer Studio** tier permitting practicing astrologers to manage client profiles, record consultation notes, and export white-label PDF reports with customized practice branding.

**Platform as Intermediary:** Siddhanta acts solely as a software technology platform and ephemeris provider. We do not employ, endorse, vet, or certify independent astrologers using our software.

**Independent Astrologer Responsibility:** Astrologers using Siddhanta are independent service providers and remain solely responsible for:

- Ensuring legal compliance of their practices under local regulations (including consumer protection laws and statutory astrology disclaimers).

- Securing client consent before storing client birth data and consultation notes on the Platform.

- The accuracy and ethical integrity of advice provided to clients.

**Consultation Disputes:** Any dispute, fee disagreement, or claim arising between an astrologer and their client is strictly between those parties. Siddhanta disclaims all liability related to astrologer-client interactions.

7. Developer API & Fair Use Policy

**API Keys:** Enterprise and developer accounts may receive API keys to programmatically query Siddhanta's Vedic calculation engines (Kundli, Panchang, Milan).

**Rate Limits & Quotas:** API keys are subject to strict per-minute rate limits and monthly credit caps. Tampering with or circumventing rate limits is prohibited and results in immediate key revocation.

**Prohibited Activities:** You may not:

- Resell, sublicense, or redistribute raw API access to third parties without prior written consent.

- Use our API to train competing machine learning models or replicate our proprietary ephemeris engines.

- Launch denial-of-service (DoS) attacks or automated scraping scripts against our endpoints.

8. Intellectual Property Rights

**Platform IP:** The Siddhanta platform, 3D celestial visualization shaders, procedural retrograde orrery algorithms, astrological math implementations, software code, UI designs, trademarks, and logos are the proprietary property of Siddhanta and Yeshwanth Dornala, protected by copyright, trademark, and international intellectual property laws.

**Limited User License:** We grant you a revocable, non-exclusive, non-transferable, limited license to access and use the Platform for your personal or authorized professional astrological practice.

**User Content:** You retain ownership of personal notes and client records you enter. By uploading content, you grant Siddhanta a worldwide, royalty-free license to host, store, and process this content strictly for providing the Services to you.

9. Prohibited Conduct

When using Siddhanta, you agree **not** to:

Violate any local, national, or international laws, including consumer protection and data privacy acts.

Claim or advertise that astrological forecasts from Siddhanta are infallible, 100% guaranteed, or certified scientific medical diagnoses.

Exploit, probe, or scan the vulnerability of our authentication systems or database endpoints.

Inject malicious code, cross-site scripting (XSS), or SQL injection payloads into profile names, notes, or API fields.

Use the Platform to harass, defame, or stalk individuals by tracking astrological data without their knowledge or consent.

10. Third-Party Integrations & Attribution

**OpenStreetMap / Nominatim:** Geocoding place searches utilize OpenStreetMap data, available under the Open Database License (ODbL). Nominatim usage is strictly throttled to conform with OpenStreetMap Foundation acceptable use policies.

**Astronomical Ephemeris:** Astronomical planetary calculations utilize mathematical formulations based on Jean Meeus astronomical algorithms and Keplerian orbital perturbations.

11. Disclaimer of Warranties

**SIDDHANTA IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE CALCULATIONS WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE DOWN TO THE ARCSECOND UNDER ALL HISTORICAL OR EXTREME POLAR CONDITIONS.**

12. Limitation of Liability

**TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SIDDHANTA, ITS FOUNDERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, EMOTIONAL DISTRESS, PERSONAL RELATIONSHIP DISPUTES, OR FINANCIAL DECISIONS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.**

**OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE STRICTLY LIMITED TO THE AMOUNT PAID BY YOU TO SIDDHANTA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD \$50 (WHICHEVER IS LOWER).**

13. Indemnification

You agree to defend, indemnify, and hold harmless Siddhanta, its operators, affiliates, and contractors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) resulting from:

Your violation of these Terms or applicable laws;

Your use of astrological readings to provide unlicensed medical, financial, or legal counsel to third parties;

Any dispute between you (as an astrologer) and your clients.

14. Dispute Resolution & Governing Law

**Governing Law:** These Terms and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the laws of **India**, without giving effect to any choice or conflict of law provision.

**Jurisdiction & Arbitration:** Any dispute, controversy, or claim arising out of or relating to this Agreement shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be **Hyderabad, Telangana, India**, and proceedings shall be conducted in English by a sole arbitrator mutually appointed by the parties.

**Courts:** Subject to the arbitration clause above, the competent courts in Hyderabad, Telangana, India shall have exclusive jurisdiction.

15. Severability & Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and Siddhanta concerning the Platform.
